Terms of Service

By accessing or using SwarmBase's website, protocol, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must not use our Services. These Terms constitute a legally binding agreement between you and SwarmBase.

SwarmBase provides decentralized infrastructure for autonomous AI agent swarms, including: SwarmCore (orchestration engine), ComputeMesh (decentralized GPU network), HiveMind (agent-to-agent messaging), Proof of Swarm (verification protocol), and the SwarmBase SDK (developer toolkit). Services are provided on an "as is" and "as available" basis.

You must be at least 18 years of age and have the legal capacity to enter into contracts in your jurisdiction to use our Services. By using our Services, you represent and warrant that you meet these requirements. Use of our Services is void where prohibited by applicable law.

You agree to: use the Services only for lawful purposes; not engage in any activity that disrupts or interferes with the Services; not attempt to gain unauthorized access to any part of the protocol; not use the Services to transmit harmful, illegal, or fraudulent content; and comply with all applicable laws and regulations.

SwarmBase's website content, logos, and documentation are the intellectual property of SwarmBase and protected by applicable IP laws. The SwarmBase protocol code is open-source under the MIT License (where applicable). The SwarmBase brand, name, and marks may not be used without express written permission.

Token Risk: Cryptocurrency and digital token investments are highly speculative. The value of $SWARM may fluctuate significantly or go to zero. You may lose your entire investment. Do not invest funds you cannot afford to lose.

Smart Contract Risk: Interacting with smart contracts on any blockchain involves significant risk, including bugs, vulnerabilities, exploits, and unintended behaviors. SwarmBase undergoes security audits but cannot guarantee the absence of vulnerabilities.

Regulatory Risk: The regulatory environment for cryptocurrencies and DeFi protocols is evolving. Changes in law or regulation may materially impact the ability to use or the value of the protocol or $SWARM.

SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SWARMBASE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (a) SWARMBASE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; (b) SWARMBASE'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED $100 USD OR THE AMOUNTS PAID BY YOU TO SWARMBASE IN THE PRIOR 12 MONTHS, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless SwarmBase and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

SwarmBase reserves the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on our website with at least 14 days' advance notice. Your continued use of the Services after changes constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the British Virgin Islands, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved by binding arbitration in accordance with the UNCITRAL Arbitration Rules.
